Bury given two-week reprieve as winding-up order adjourned

Written by on 17/10/2019

A judge has adjourned a bid to wind up Bury Football Club.

English Football League officials expelled the club in August after bosses failed to show they could pay debts.

The club were left on the brink of liquidation this week after a prospective buyer ended their interest on Monday, prompting supporters’ group Forever Bury to announce they would not continue their legal fight to stop the HMRC winding-up petition.

Judge Mark Mullen analysed Bury’s case at an Insolvency and Companies Court hearing in London on Wednesday after being told that the club had tax debts.

Lawyers representing HM Revenue and Customs had made an application to wind up the club, which was founded in 1885.

The judge said he would reconsider the case on October 30.

In June, the judge had heard that Bury owed nearly £1m in tax and had other debts.

Bury won promotion to Sky Bet League One, English football’s third tier, at the end of the 2018-19 campaign.

Plans for a phoenix club are in place, which would have to apply to the FA for entry into non-league football next season.

Bury FA Cup expulsion will gift one team a bye

One team will receive a bye into the second round of the FA Cup after Bury’s expulsion left an odd number of teams in the competition.

The last team left in the pot during the first round draw on Thursday will move straight into round two and collect the winning prize money of £36,000.

The remaining 47 League One and Two teams will join the 32 non-league sides who prevail from this weekend’s fourth qualifying round in the draw.
