Jamie Spears was accused of grabbing and shaking his 13-year-old grandson Sean last month.

The child’s father, Kevin Federline, alleged that Mr Spears was involved in a physical altercation with Sean on 24 August.

Mr Federline, a former backing dancer who was married to Britney Spears from 2004 to 2007, filed a police report against his former father-in-law.

He said 12-year-old Jayden, his second son with Ms Spears, was also in the house at the time of the alleged incident.

But California authorities decided not to take action and a statement from the Ventura County District Attorney’s Office said there was “insufficient proof” a crime had been committed.

Mr Federline obtained a restraining order against Mr Spears following the alleged incident, according to NBC News.

After being reported to police, Mr Spears stepped down as Ms Spears’ conservator and cited health reasons for the departure.

The request was approved on Monday and Ms Spears’ caregiver, Jodie Montgomery, was appointed as his replacement.

Mr Spears took guardianship of the singer of 2008 when she was put in psychiatric care after refusing to let go of custody of her children.

He had petitioned the court to put his daughter under his care and has since had the power to restrict Ms Spears’ visitors “by any means”, with the exception of her attorney Samuel Ingham.
